Terms of Service

1. These terms
By creating an account or using AlbertaLease you agree to these terms. If you use the service for a business or on behalf of a landlord, you confirm you are authorised to do so and to accept these terms for them. If you do not agree, do not use the service.
2. What AlbertaLease is — and is not
AlbertaLease generates residential tenancy documents for Alberta (leases, addenda, tenancy applications and receipts), provides electronic signature and keeps related records. We are not a law firm and we do not provide legal advice or representation.Document wording is based on Alberta’s Residential Tenancies Act; it is a template for common situations and may not suit yours. For complex or disputed matters, consult a licensed Alberta lawyer or the Residential Tenancy Dispute Resolution Service. You are responsible for the documents you send and for complying with the law that applies to you.
3. Your account
- Provide accurate information and use an email address you control. You must verify your email address before you can create or change records, download documents or pay. This protects you and prevents anyone claiming a share of your property by using your address.
- Keep your password confidential. You are responsible for activity under your account.
- You may delete your account at any time from Settings; see our Privacy Policy for what is erased.
4. Information you put into the service
You are responsible for the tenant, applicant and property information you enter or ask others to submit, and you confirm you have the authority and a lawful basis to do so. Under Alberta’s Personal Information Protection Actyou are the custodian of your tenants’ information; we process it on your instructions as a service provider. Use the credit-check consent and ID fields only where you have the applicant’s consent and a legitimate need.
5. Electronic signatures
Signatures applied through the service are intended to be valid under Alberta’s Electronic Transactions Act. Each signer works through the agreement, places initials on each page and confirms they reviewed it and consent to sign electronically; we record the signature, times, initials, IP addresses and a certificate. You agree not to dispute the enforceability of a document solely because it was signed electronically, and you will not alter or remove the signature record or certificate from a completed document.
6. Plans, prices and payment
- Free: 1 property with unlimited units, free receipts, and free drafting and previews of documents.
- Pay per document: lease CA$29.99, tenancy application CA$9.99 — charged when you download the official document. Drafting and previews are free.
- Pro: CA$99 per year, or CA$12 per month, for up to 3 properties with no per-document fees.
- Portfolio: CA$199 per year, or CA$24 per month, for unlimited properties, no per-document fees, and the ability to share your whole account with another person.
- Subscriptions renew at the interval you chose until cancelled. You can cancel any time and keep everything you have already generated; where you cancel part-way through a paid period, access continues to the end of that period.
- Prices are in Canadian dollars and exclude applicable taxes (GST) where required. See our refund policy.
7. Acceptable use
- Do not use the service for anything unlawful, or to harass, discriminate against or defraud anyone.
- Do not enter information you are not entitled to hold, or send signing invitations to people who have not agreed to receive them.
- Do not scrape, resell, copy or reverse engineer the service, or attempt to access another account or data.
- Do not upload malware or files you do not have the right to store.
8. Your content
Your documents and records remain yours. You grant us only the licence needed to host, process, email and display them so we can operate the service for you.
9. Availability and changes
We work to keep the service available but do not guarantee uninterrupted operation. We may change, add or retire features; if we discontinue the service we will give reasonable notice so you can download your records.
10. Suspension and termination
We may suspend or close an account that breaches these terms, is used for abuse or fraud, attempts to bypass verification or plan limits, or where required by law. You may stop using the service at any time and delete your account.
11. Disclaimers and limits on liability
The service is provided “as is” to the extent permitted by law. We are not responsible for the outcome of a tenancy dispute, for decisions you make using the documents, or for loss caused by information you or an applicant supplied incorrectly. To the maximum extent permitted by law, our total liability arising out of the service is limited to the amount you paid us in the twelve months before the claim, and we are not liable for indirect or consequential loss. Nothing in these terms limits rights you have that cannot be limited by law.
12. Indemnity
You indemnify us against claims arising from information you entered without authority, from your unlawful use of the service, or from a tenancy dispute between you and another party.
13. Governing law
These terms are governed by the laws of Alberta and the federal laws of Canada applicable there, and the courts of Alberta have exclusive jurisdiction.
14. Changes to these terms
We may update these terms; material changes will be notified by email or in the app before they take effect.
